Terms and conditions

1. About these terms
These terms apply to your use of beyondordinary.digital (the "Website") and explain, in plain English, how we generally work with clients. The Website is operated by Beyond Ordinary (trading as Beyond Ordinary Digital), run by Jon Quayle, 36 Hildon Close, Worthing, West Sussex, BN13 2SP, United Kingdom.
Contact: studio@beyondordinary.digital.
By using the Website you agree to these terms.
Working with us: every project is governed by a written proposal and a signed Design and Development Services Agreement. Sections 6 to 16 below summarise our standard approach. If there is any conflict between these terms and a signed agreement or proposal, the signed agreement and proposal take priority.
2. Who our services are for
We provide brand identity, strategy, and website design and build services to businesses and organisations. Our services are not aimed at consumers. If you are contracting as an individual for purposes outside your trade or business, tell us, as consumer protection law may give you additional rights that nothing in these terms limits.
3. Using the Website
You agree to use the Website lawfully and not to:
- attempt to gain unauthorised access to the Website, our systems or other users' data
- introduce malware or interfere with the Website's operation
- scrape, copy or reuse content in bulk without our written permission
- use the Website to send spam or unsolicited commercial messages
4. Intellectual property in the Website
All content on the Website, including text, design, code, graphics, logos, animations and case studies, is owned by or licensed to us and protected by copyright and other intellectual property rights. You may view the Website and share links to it. You may not copy, reproduce, modify or distribute any content for commercial purposes without our written permission.
The Beyond Ordinary name and logo are our brand. Please don't use them in a way that suggests endorsement or affiliation without our agreement.
5. Website information and availability
We aim to keep the Website accurate and available, but we provide it "as is". We don't guarantee it will be uninterrupted or error-free. Content on the Website is general information, not professional advice for your specific circumstances. Links to third-party sites are for convenience, and we aren't responsible for their content.
6. Proposals and project scope
- Every project starts with a written proposal setting out the deliverables, specifications, number of revision rounds, timeline, and anything explicitly not included.
- Work begins once the proposal and agreement are signed and the deposit is received.
- Proposal prices are based on the scope and timeline agreed. Quotes are valid for the period stated in the proposal.
7. Changes to scope
You're free to change your mind, and we'll be flexible. Anything outside the agreed proposal is a scope change. Scope changes are:
- agreed in writing (email or change order)
- quoted separately with any cost and time implications
- started only once you've approved them in writing
Changes requested after design approval or after development of the affected area is complete may incur additional charges for rework, even if the earlier work was approved. Minor tweaks that don't materially add complexity may be accommodated at our discretion.
8. Your responsibilities
- Provide content, assets, access and information in the agreed formats and timescales.
- Give feedback and approvals within 7 days of receiving deliverables, unless you've told us otherwise. Delays extend the timeline and may lead to rescheduling and additional costs.
- Nominate one main point of contact and provide consolidated feedback where several people are involved.
- Make sure you own, or are properly licensed to use, everything you give us (text, images, fonts, logos and other materials), and be responsible for any third-party claims arising from it.
- Be responsible for your own legal compliance on the finished site, including privacy notices, cookie policies and accessibility statements as applicable.
9. Payment
Our fees are in pounds sterling (GBP) and are staged against milestones. Our standard schedules are:
Website and digital product projects
- 40% deposit to start
- 20% on design concept approval
- 30% on development completion and approval
- 10% on final delivery or launch and handover
Brand identity projects
- 50% deposit to start
- 40% on design concept approval
- 10% on final delivery of files and assets
Invoices are payable within 5 business days of the invoice date. We release final files and go live within 24 hours of confirmed payment. We may suspend work if payment is more than 14 days overdue. If an invoice is paid late, we may claim statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998. If you pay in another currency, you cover any international transfer charges. Out-of-pocket expenses are not invoiced unless agreed in advance.
10. Third-party costs
Our fees don't include third-party costs unless the proposal says so. These typically include hosting, domains, content management or software subscriptions, plugins, stock imagery and video, font licences, SSL certificates, email services and printing. We'll discuss costs with you before you commit. Where possible, accounts are set up in your name so that you are the licence holder. We can recommend and help set up providers, but we can't guarantee their availability or performance and aren't liable for their costs, outages or issues.
11. Ownership and licences
- No rights until paid. We keep all intellectual property rights in deliverables until the final invoice is paid in full. No licence or usage rights pass to you before then.
- Brand deliverables. Once paid in full, ownership of the final, approved brand deliverables (such as logos, brand marks and guidelines) is assigned to you. Unused concepts and rejected directions remain ours.
- Websites and code. We retain ownership of source code and code-based deliverables. Once paid in full, you receive an exclusive, perpetual, royalty-free licence to use the delivered website or digital product. A transfer of the repository to your own account can be arranged and may carry a small fee.
- Our tools. Any frameworks, boilerplates, libraries or templates we've built remain ours and may be used only as part of the delivered product.
- Open source. Projects may include open-source or third-party components, which stay under their own licences.
12. Portfolio and credit
Unless you ask us not to, or it would breach confidentiality, we may show and write about our work with you, including finished projects and work in progress, in our portfolio, case studies, articles and social media. We may also place a subtle credit with a link, such as "Design and code by Beyond Ordinary", in the footer of the website or product we build. If you have a legitimate confidentiality need (a pre-launch product or an NDA, for example), tell us in writing and we'll withhold specific work for an agreed period or indefinitely.
13. Confidentiality
We keep non-public information you share with us confidential and use it only to deliver your project. This applies to any subcontractors we might use too. Confidentiality continues after the project ends. Your agreement contains the full terms.
14. Warranty and support
We offer a 30-day period after project completion during which we'll fix bugs or technical issues caused by our work at no extra cost. This doesn't cover issues caused by third-party services or tools, modifications made by you or others, content changes or user error. Ongoing support and maintenance can be provided under a separate agreement.
15. Artificial intelligence
We don't use generative AI to produce creative or development work for clients. You're welcome to use AI tools on the work we deliver, but:
- we aren't liable for issues caused by modifications to deliverables made by you or third parties, including through AI tools
- support for modified versions may be charged at our then-current hourly rate
- we'll discuss requested changes with you directly, and don't revise deliverables on the basis of AI-generated feedback alone
- you may not use our proprietary processes, methods or work samples to train AI models without our written consent
16. Pausing or ending a project
Either party can pause or end a project in the circumstances and with the notice set out in the agreement. In summary, if you end a project you pay for work completed up to the end of the current milestone. If we end a project because of unforeseen circumstances, we deliver completed work and refund payments for work not started. Completed work is handed over once outstanding payments are settled.
17. Our liability
We work to the standard expected of a qualified, experienced professional and will always try to correct errors, but we can't guarantee that work will be free of errors.
To the extent the law allows, our total liability to you in connection with our services is limited to the fees you've paid us for the services in question, and we aren't liable for indirect or consequential loss such as lost profit, lost savings or lost data. For use of the Website itself, we exclude liability for loss arising from your use of it, to the extent the law allows.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot legally be limited.
18. Events beyond our control
We aren't responsible for delay or failure caused by events outside our reasonable control, including illness, power or internet failures, severe weather, epidemics, fire, flood and war. If such an event prevents us from performing for more than 30 days, you may cancel the agreement without penalty.
19. Data protection
We handle personal data in line with our Privacy Policy above and applicable UK data protection law.
20. General
- Changes. We may update these terms. The version on the Website when you use it applies to your use of the Website. Terms in a signed agreement are only changed by written agreement.
- Transfer. Neither party can transfer an agreement to anyone else without the other's written consent.
- Severability. If any part of these terms is found unenforceable, the rest remains in force.
- Entire agreement. A signed agreement and proposal, together with these terms where not in conflict, make up the whole arrangement between us.
- Governing law. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also have the right to bring proceedings in your home nation of the UK.
